Agreement to Terms
These Terms of Service govern your access to and use of the DataRadius platform, including the dashboard, API, RADIUS services, VPN tunnels, and any related services provided by DataRadius. By creating an account or using the platform, you agree to be bound by these terms.
Definitions
"Platform" means the DataRadius ISP billing and network management service, accessible via your workspace at dataradius.co.ke. "Workspace" means the isolated tenant environment created for your ISP. "Subscriber" means an end-user of your internet service whose data is processed through the platform. "Service Data" means all data you or your subscribers upload, generate, or transmit through the platform.
Your Account
You are responsible for maintaining the confidentiality of your account credentials, including any API keys. You must enable multi-factor authentication for accounts with administrative privileges. You agree to notify us immediately of any unauthorized access. Each workspace is isolated — you may not attempt to access another workspace's data.
Permitted Use
You may use the platform to manage internet service subscribers, configure MikroTik routers via WireGuard tunnels, process payments through integrated payment gateways, and operate your ISP business. You must comply with all applicable laws, including Kenya's Data Protection Act 2019 and any regulations governing telecommunications in your jurisdiction.
Payments and Billing
DataRadius charges a usage-based fee: 1.8% of hotspot sales and KSh 18 per PPPoE subscriber per month, with a KSh 500 monthly minimum after the 14-day free trial. Payment gateway fees (e.g. M-Pesa Daraja charges) are separate and collected by the gateway provider. You are responsible for maintaining a valid billing method. Unpaid accounts may be suspended after 14 days' notice.
Data Ownership
You own your Service Data. DataRadius processes it solely to provide the platform services. You may export your subscriber records, payment history, and network configuration data in standard formats at any time. Upon account termination, your data is retained for 30 days (for recovery purposes) and then permanently deleted.
Security
DataRadius encrypts all data at rest using AES-256-GCM and in transit using TLS 1.2 or higher. VPN keys, RADIUS secrets, and API tokens are encrypted at the application level before reaching the database. Each workspace is isolated using PostgreSQL Row-Level Security. We maintain audit logs of all significant actions.
Service Availability
We aim to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance is communicated in advance via email and the public status page. Our recovery targets are RPO of 1 hour and RTO of 30 minutes.
Limitation of Liability
To the maximum extent permitted by law, DataRadius is not liable for indirect, incidental, consequential, or punitive damages, including lost revenue, lost data, or business interruption. Our total aggregate liability is limited to the fees you paid in the 12 months preceding the claim.
Termination
Either party may terminate this agreement with 30 days' written notice. We may suspend your account immediately if you violate these terms or the Acceptable Use Policy. Upon termination, you have 30 days to export your data before it is permanently deleted.
Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
Governing Law
These terms are governed by the laws of Kenya. Disputes shall be resolved by the courts of Nairobi, Kenya.
